Terms and Conditions for Photographers
Welcome to DWH Marketing!
By registering and using the platform provided by DWH Marketing, photographers agree to comply with the following terms and conditions. Please ensure that they are read carefully.
1. Acceptance of Bookings
Photographers registered with DWH Marketing are required to accept all bookings made through our platform. Failing to honor a booking will be considered a breach of these terms.
2. Cancellation and Refunds
Client Cancellations:
- More than 72 Hours Notice: If a client cancels a booking more than 72 hours before the scheduled photoshoot, they will receive a full refund minus an R10 administration fee, which will be retained by DWH Marketing.
- 48 to 72 Hours Notice: If a client cancels a booking between 48 to 72 hours before the scheduled photoshoot, they will receive a 50% refund. The remaining 50% of the payment will be split, with 40% going to the photographer and 10% to DWH Marketing.
- Less than 48 Hours Notice: If a client cancels less than 48 hours before the scheduled date, no refund will be issued. The full payment will be split, with 85% going to the photographer and 15% to DWH Marketing.
Photographer Cancellations:
- If photographers cancel a booking at any time after it has been confirmed, the following will apply:
- The customer will receive a full refund.
- Photographers will be responsible for covering all banking fees associated with the refund. These include:
- A refund processing fee of R2.00.
- An additional charge of R15.00 imposed by DWH Marketing for administrative costs incurred due to cancellation.
3. Rescheduling Policies
When Photographers Reschedule:
More than 72 Hours Prior: Photographers must notify DWH Marketing and the client at least 72 hours before the scheduled photoshoot if they need to reschedule. Rescheduling within this timeframe will incur no penalties.
48 to 72 Hours Prior: If a photographer reschedules between 48 to 72 hours before the scheduled photoshoot, they must first confirm the new date with the client. If the client agrees to reschedule, the photographer will be charged a penalty of R10.00. If the client does not agree to reschedule and requests a refund instead:
- The client will be refunded in full.
- The photographer will incur:
- A refund processing fee of R2.00.
- An additional charge of R30.00 imposed by DWH Marketing for administrative costs.
Less than 48 Hours Prior: If a photographer reschedules less than 48 hours before the scheduled photoshoot:
- If the client agrees to reschedule, the photographer will be charged a penalty of R30.00.
- If the client does not agree to reschedule and requests a refund instead:
- The client will be refunded in full.
- The photographer will incur:
- A refund processing fee of R2.00.
- An additional charge of R30.00 imposed by DWH Marketing for administrative costs.
When Clients Reschedule:
More than 72 Hours Prior: Clients may reschedule their photoshoot at least 72 hours prior to the scheduled date without any additional charges. The new date must be agreed upon by both the photographer and the client.
48 to 72 Hours Prior: If a client wishes to reschedule between 48 to 72 hours before the scheduled photoshoot, they will be charged a rescheduling fee of R10.00, which will be retained by DWH Marketing to cover administrative costs. DWH Marketing will invoice the client on the day the new booking is reported by the photographer. Photographers may not accept the rescheduled booking until proof of payment is received. Confirmation of the booking will be communicated by DWH Marketing once payment is confirmed.
Less than 48 Hours Prior: Should a client request to reschedule less than 48 hours before the scheduled photoshoot, they will be charged a rescheduling fee of R30.00. This fee reflects the increased inconvenience and administrative burden close to the date of the event. DWH Marketing will invoice the client on the day the new booking is reported by the photographer. Photographers may not accept the rescheduled booking until proof of payment is received. Confirmation of the booking will be communicated by DWH Marketing once payment is confirmed.
4. Management of Availability
Photographers are solely responsible for ensuring that their availability on the platform is accurate and updated frequently. DWH Marketing will not manage or oversee their availability schedules. Failure to maintain accurate availability may lead to financial penalties or other consequences.
5. No Modification of Client Information
Photographers may not alter any client information provided through the platform. All client details on bookings must be respected and handled with confidentiality and accuracy. Unauthorized changes are strictly prohibited and subject to penalties.
6. Compliance with Policies and Regulations
Photographers agree to adhere to all applicable laws and regulations, as well as the policies outlined by DWH Marketing, while using the platform. Non-compliance may result in suspension or termination of their access to our services.
7. Indemnification
Photographers agree to indemnify and hold harmless DWH Marketing and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of their breach of these terms, their use of the platform, or their violation of any law or the rights of a third party.
8. Limitation of Liability
DWH Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from photographers’ access to or use of or inability to access or use the services.
9. General Conditions
We reserve the right to modify or terminate the service for any reason, without notice, at any time. We also reserve the right to alter these terms and conditions at any time. Changes to terms will be posted on our website and effective immediately upon posting.
10. Governing Law
These terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
Continued use of the platform following any amendment of these terms and conditions will signify photographers’ assent to and acceptance of its revised terms.
